The Democratic Alliance caucus in the Ba-Phalaborwa Municipality, Limpopo, has called for the immediate removal of ANC Mayor Mirriam Malatji from office.
Lebo Rakoma, DA caucus leader in Ba-Phalaborwa, demands that Malatji “either resign in disgrace, be recalled by the ANC, or face formal removal”.
This follows a police complaint filed by a municipal intern in a rape case (case number 269/7/24 – Namakgale).
“The complainant alleges that Mayor Malatji, accompanied by Exco and ANC member Thompson Nkuna, visited her and her family to coerce her into withdrawing the rape charges against the accused—a senior municipal manager,” said Rakoma.
“A leaked voice recording of the encounter, submitted as evidence, reportedly reveals the Mayor and Nkuna claiming to act on behalf of the accused, who sought forgiveness and offered monetary compensation in exchange for the charges being dropped. Tragically, the accused has since committed suicide.”
Rakoma said the actions of Malatji and Nkuna were unacceptable, particularly during the global 16 Days of Activism Against Gender-Based Violence.
“Their conduct, at face value, appears criminal. Attempting to persuade a complainant to withdraw charges constitutes obstruction of justice and may amount to intimidation under the Intimidation Act,” said Rakoma.
“Both officials seem to have violated the Code of Conduct for Councillors, while Mayor Malatji has likely breached her Oath of Office, which demands that she uphold the Constitution, act with honour, and preserve the dignity of her position.”
It is further alleged that Limpopo premier Phophi Ramathuba is aware of the matter.
“As Premier, provincial ANC leader, and a woman, she must address these allegations and explain her inaction. The ANC, as the governing party, must also be held accountable,” said Rakoma, adding that the Speaker of the Council must investigate the matter under the Municipal Structures Act and the Councillors’ Code of Conduct.
The DA said it would call for a special council meeting and move a motion for Malatji’s removal.
Additionally, the DA will write to the MEC for Cooperative Governance, Human Settlements, and Traditional Affairs (COGHSTA) to initiate an investigation and lodge a complaint with the Public Protector.
The DA also plans to meet with the Namakgale Police Station Commissioner for updates on both the rape case and the alleged misconduct of Malatji and Nkuna.
“Should action prove insufficient, the matter will be escalated to the Independent Police Investigative Directorate (IPID),” said Rakoma.
“The DA remains resolute: Mayor Malatji must be removed from office, justice must prevail, and the rights and integrity of women must be restored.”
