SAMWU slams Emfuleni Municipality for burning R55 million to avoid paying R211 000 to an employee

Mpho Tladinyane, SAMWU Gauteng Provincial Secretary, has lambasted the Emfuleni Municipality over claims that R55 million in legal fees, originally earmarked for service delivery, has been squandered just to avoid paying a worker a mere R211,000.

Tladinyane said that the scandal is not just a betrayal of workers and residents but a stark illustration of the municipality’s “greed, incompetence, and disregard for collective bargaining”.

“The municipality’s actions have forced a dedicated worker to endure unnecessary delays, humiliation, and uncertainty. The South African Local Government Bargaining Council (SALGBC) and the courts have affirmed what we knew all along: the municipality owes the money, the worker’s case is justified, and the payment is long overdue,” said Tladinyane.

Tladinyane said SAMWU demands immediate compliance with the ruling and an end to wasteful spending on legal battles that undermine collective bargaining.

“Emfuleni must cease its reckless pursuit of workers and start honoring its commitments,” he said.

“This isn’t just about one case; it’s about Emfuleni’s broader attack on the foundational principles of collective bargaining in South Africa’s labor laws,” Tladinyane continues.

“Instead of prioritising essential services and employee salaries, the municipality chooses to waste millions while residents suffer.”

He highlighted Emfuleni’s chronic failure to pay workers on time, noting a recent incident in December that marred the festive season for many families.

“Despite owing billions to Eskom and Rand Water, Emfuleni somehow finds R55 million for needless legal fees,” Tladinyane said.

“This money could have alleviated debt, repaired infrastructure, and enhanced services for residents. Instead, it’s a testament to the municipality’s arrogance and mismanagement,” he added.

SAMWU demands accountability and urges thorough investigations into this misuse of public funds.

“Those responsible for this reckless expenditure must be held personally liable,” Tladinyane said.

“They cannot hide behind their positions while the municipality flounders.”

“We demand immediate implementation of the SALGBC ruling, an end to the war on workers, and prudent financial management from Emfuleni,” Tladinyane said.

“This situation is intolerable, and we stand firm against continued suffering caused by inept leadership and financial mismanagement.”
