The Democratic Alliance (DA) in Tshwane has opened a criminal complaint against Deputy Mayor Eugene Modise.
This move follows the DA’s call for a thorough investigation into the circumstances surrounding Triotic Protection Services’ contract with the City of Tshwane, citing potential contraventions of the Prevention and Combating of Corrupt Activities Act, 12 of 2004.
The complaint stems from allegations that Modise failed to declare and divest his interests in Triotic Protection Services, a company that has secured lucrative contracts with the municipality.
A R59 million judgment was granted in favour of SARS against Triotic Protection Services in August 2023. The DA’s Cilliers Brink said this “raises the question whether at material times the company submitted the tax clearance certificate necessary to do business with the state”.
The DA said that Modise continued to benefit from these contracts, which was a clear breach of the Code of Conduct for Councillors.
There was a need for a thorough investigation “in terms of the Prevention and Combating of Corrupt Activities Act, 12 of 2004, into the circumstances under which Triotic’s contract with Tshwane was procured and extended,” Brink said.
He also criticised Mayor Nasiphi Moya for retaining Modise as Member of the Mayoral Committee for Finance, despite knowing about the alleged unlawful benefits.
“Moya’s failure of leadership sets a terrible example for Tshwane officials,” Brink said.
“In preparing our complaint, we have been assisted by the private prosecution unit of Afriforum under former NPA prosecutor, Adv Gerrie Nel,” Brink said.
